1. Scope and seller
1.1 These Terms and Conditions apply to all contracts concluded via the online shop pumpedpongo.com between Volker Strugalla, trading as pumpedpongo, Feldweg 13, 31559 Hohnhorst, Germany, email info@pumpedpongo.com (“we”, “us”) and our customers (“you”).
1.2 Our offer is directed exclusively at consumers. A consumer is any natural person who concludes a contract for purposes that are predominantly outside their trade, business or profession.
1.3 Deviating terms of the customer do not apply.
2. Conclusion of the contract
2.1 The presentation of products in our shop is not a legally binding offer, but an invitation to place an order.
2.2 You can place products in the shopping cart by selecting colour and size and clicking “Add to cart”. In the checkout you enter your address and choose a payment method. Before submitting your order you can review all details on an overview page and correct input errors using the usual keyboard and mouse functions or the “Back” function of your browser.
2.3 By clicking the button “Pay and place binding order” you submit a binding offer to purchase the goods in your cart and enter into an obligation to pay.
2.4 The contract is concluded when we accept your offer by sending an order confirmation by email.
2.5 If you pay via PayPal, the payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A. The contract is still concluded as described in 2.4.
3. Contract language and storage of the contract text
3.1 The contract language is English.
3.2 We store the contract text. You receive the order details and these Terms and Conditions by email. You can view your past orders in your customer account if you have created one.
4. Prices and shipping costs
4.1 All prices include the statutory VAT. Prices are shown in euro or, depending on your location, in another currency such as US dollars; the currency shown at checkout applies.
4.2 Shipping is currently free of charge. Any shipping costs are shown on the product page and before you submit your order.
4.3 For deliveries to countries outside the European Union, customs duties, import taxes or fees may arise. These are borne by you and are not included in our prices.
5. Delivery
5.1 We deliver to the countries listed in the checkout.
5.2 Our products are printed individually after your order. The delivery time is stated on each product page (currently approx. 5–11 business days) and begins on the day after conclusion of the contract.
5.3 Your order may be shipped in several parcels; this does not cause additional costs for you.
6. Payment
6.1 The available payment methods are shown in the checkout, currently credit/debit cards and PayPal; depending on your country also Bancontact, EPS or iDEAL.
6.2 Your payment method is charged when you submit your order.
7. Retention of title
The goods remain our property until full payment of the purchase price.
8. Right of withdrawal
As a consumer you have a statutory right of withdrawal. Details can be found in our Right of Withdrawal. You can also withdraw using our online withdrawal function: Withdraw from contract.
9. Statutory warranty rights
9.1 The statutory warranty rights for defects apply (§§ 434 ff. German Civil Code). The warranty period is two years from delivery.
9.2 Please report obviously damaged or defective goods to us as soon as possible. Failure to do so has no effect on your statutory rights.
10. Liability
10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
10.2 In cases of slight negligence we are liable only for breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In this case our liability is limited to the typical, foreseeable damage.
11. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, this choice of law does not deprive you of the protection of the mandatory provisions of the law of that country.
12. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
